The Clorox Company VP - Assistant General Counsel & Chief IP Counsel in Oakland, California

Reporting to the Executive Vice President - General Counsel & Corporate Affairs, the Chief IP Counsel will be responsible for Clorox's IP legal strategy and will oversee and manage all aspects of Clorox's trademarks, copyrights, trade dress, patents, rights of publicity, licensing and other IP. The candidate will oversee the management and expansion of global IP portfolios, including acquired IP portfolios, and set the strategic direction for IP initiatives. The position will counsel the Company on all IP issues in agreements and business relationships and also manage IP training for all Clorox functions. The successful candidate will lead and develop a high-performing and experienced legal team comprised of lawyers, paralegals and other professionals and will serve on the Clorox Legal Leadership Team. Key Responsibilities

  • Provide strategic counsel to the business regarding the competitive IP landscape for the company's current global product portfolio and future plans.

  • Provide strategic guidance in global legal matters relating to IP, providing pragmatic and sound legal advice in a manner that facilitates business results.

  • Manage internal team and outside counsel in the effective and efficient preparation and prosecution of patent and trademark applications around the world.

  • Create and implement fiscally-responsible, global IP strategy with consideration of resources, including developing, maintaining and optimizing a broad global portfolio in a cost effective manner.

  • Drive FTO and IP clearance with proactive evaluation and resolution of clearance issues to align with changing business priorities.

  • In conjunction with members of Clorox's litigation team, investigate IP enforcement opportunities, manage IP-related disputes (including trademark, patent, Lanham Act, US PTO/TTAB actions as well as other IP claims impacting the business globally), efficiently manage outside counsel and drive results that reflect business priorities and contain necessary protections for the company.

  • Implement training and design processes to enhance the management and protection of Clorox's IP.

  • Support IP-related M&A due diligence activities.

  • Manage, develop and engage a diverse group of high performing IP professionals.

  • Recruit, coach and develop organizational talent.

  • Build strategic partnerships with business and R&D teams, as well as outside counsel, to further organizational objectives.

  • Develop and manage IP legal budget.

Minimum Qualifications

Years and Type of Experience:

  • At least 12+ years of experience in patent, trademark, copyright and/or trade secret matters, with a focus on consumer products a plus.

  • Proven strong performer with experience in IP dispute resolution, including federal and state court litigation.

  • Experience at a top-tier law firm (in-house experience a plus).

  • Demonstrated success at providing strategic counseling to business partners that takes into account legal considerations along with business goals.

  • Excellent interpersonal and communication skills and demonstrated ability to manage, develop, engage and lead legal professionals.

  • Ability to successfully interact with executives, business management teams and legal colleagues to deliver legal strategies on complex legal issues.

Education level/degree

  • JD degree and BA/BS degree; top tier undergraduate and law schools.

  • Member of the California State Bar, or eligible to register under the California State Bar in-house counsel program.
